The Utah law specifies a minimum sentence for first time DUI offenders.  Specifically, a Defendant must serve 48 consecutive hours in jail or perform 48 hours community service or serve a period of time of electronic home confinement.  There is a minimum fine of $700 plus an 85% surcharge, specifically, $1295, plus other court costs.  The Court will order the defendant to submit to an alcohol screening & assessment with a licensed provider. The Court will require the Defendant to complete a DUI educational series, unless treatment is ordered.  Depending on the facts, the Court may order treatment.  The Court may order supervised probation. The Court, depending on the facts, may order ignition interlock.

If a Defendant has a blood alcohol content of .16, or higher, the court shall order supervised probation.  If the Court does not order treatment, then the Court shall order the installation of an ignition interlock or home confinement. 

With respects to the Defendant's license, the Court may order, in addition to what the Driver's License Division imposes, may order an additional 90 days, 180 days, 1 year or 2 years.
